Jana Meier is a skilled patent attorney with extensive experience advising clients on a wide range of strategic intellectual property matters primarily in the life science sector.  For nearly a decade, Jana has worked closely with clients ranging from multinational corporations to early-stage technology startups and nonprofit universities and research institutions.  Her A-Z approach and deep understanding of her clients’ technologies and objectives, she has become a legal counsel of choice for many companies and technology transfer institutions - primarily in South America - seeking to appropriately protect and maximize the value of their intellectual property in the United States.


Jana has significant experience drafting complicated patent applications and handling all stages of patent prosecution, as well as in strategic counseling, due diligence, licensing, and preparing complex freedom-to-operate and patent validity opinions.  In view of her scientific background, her areas of expertise are heavily focused in the chemical and biotechnology arts, including molecular biology, immunology, immunotherapies, protein chemistry, recombinant technologies, genome editing, gene therapies, microarray technologies, molecular diagnostics, biological and small organic therapeutic compounds and uses, drug conjugates, medical and research diagnostic assays, biomarkers, nanotechnology, pharmaceuticals, food science, and agricultural biotechnology.  An additional area of Jana’s expertise is in plant technologies, including not only utility plant patents, but also plant patents under 35 U.S.C. 161 and Plant Variety Certificates.

As more and more life science inventions are becoming affected by the ever-evolving standard for patent eligibility, and pharmaceuticals and biosimilars are subject to increased regulatory and legislative action, Jana is skilled at devising strategies for ensuring patent eligibility for such inventions.  Staying at the forefront of legal developments and actively participating in the USPTO’s rulemaking, she has an exceptional understanding of the legal and administrative challenges facing life science companies and has become a regular and sought-after speaker on these topics.  Moreover, Jana’s understanding of the laws and regulatory processes affecting successful commercialization of products in the health care industry has allowed Ms. Nelson to also provide counseling regarding Food and Drug Administration (FDA) notifications and approvals, prepare paragraph IV Certifications under the Drug Price Competition and Patent Term Restoration Act (Hatch-Waxman), and advise on the suitability of post-grant USPTO proceedings for achieving clients’ goals. 

Prior to moving to South Carolina to join her law school colleagues, Gregory Finch and John Paolino, Jana worked as a patent attorney in the chemical and biotechnology groups of two renowned IP boutique law firms in Virginia, and also as the sole IP attorney in the D.C. office of a large international law firm.  Born and originally raised in Europe, Jana is also fluent in Czech and Swedish.
